This document sets out the Terms and Conditions you need to be aware of when using this website or purchasing from me. Please take a moment to read it, as it sets out the terms of our relationship so that we may both benefit from clear boundaries and knowing what to expect from each other.

When you visit this website, use my services or purchase my products you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t agree, you should not continue to visit this website or purchase from me.

This document may be changed or modified from time to time. Please check back regularly to ensure you are aware of any changes.

There may be additional specific terms of service provided to you in relation to my products and services, for example in the ‘client agreement and consent form.’. If there is any inconsistency between these documents and those specific terms of service, these Website Terms & Conditions are overruled to the extent of the inconsistency.

All products and services advertised on this website are offered in compliance with Australian Consumer Law.

On this website and my social media accounts you may find information about women’s sexual health and well-being. This information is provided solely for your education and personal development to help you live a life of sexual empowerment that is unique to you.

I take lots of care to provide valuable information but I cannot be responsible for the use that you make of that information.

It is important that you understand that generalised information about health and well-being is never a substitute for personal medical advice.

There is no professional relationship formed by your visit to my website unless you explicitly choose to work with me by purchasing my services or products. 

Any testimonials or results I may display on this website are based on my experience and those of my previous clients. They are not guarantees that anyone else will achieve the same results.

There are a number of ways you may choose to work with me that are available to purchase or book through my website. The terms and conditions in this document apply to all of my services and products unless alternative terms are explicitly provided to you.

I offer:

My intention in offering these services and products is to help support your physical, emotional and energetic health and well-being.  Sexual health products are designed to help you make choices and decisions that may lead to an improved sex life.    

Why Work with Me?

I am a qualified medical practitioner (non-practicing) registered with AHPRA MED0001936616.  I am also a Sexologist, Masters of Medicine Sexual and Reproductive Health (Psychosexual Therapy) and Counsellor (Diploma of Counselling). I also hold level 1 training in Sensori-Motor Psychotherapy (somatic therapy).  

Your Responsibility

It is your responsibility for your own safety, including taking ownership over your health and health care decisions. While seeing me as a Sexologist am not acting as your doctor and we have not entered a doctor patient relationship. I will not be acting as a medical doctor, I may be part of your care team and may suggest investigations and medication/treatment for your health care team to consider.

On purchasing sexual health and well-being products is it your responsibility to research products to determine if they are appropriate for you.  It is your responsibility to use products as they are intended to be used.

Important Information

By working with me you can expect professional interactions. You will get the most value out of working with me by being open, respectful and having a mindset that places importance on sexual health and well-being. It is important to know that sexual health and well-being work can be very triggering and it is strongly advised that you have a professional and non-professional supportive network outside of myself for ongoing mental health support.

With any sexual wellness work or sexual healing, it is also important to be patient, gentle and kind with yourself. It may take one or multiple sessions to improve sexual health and welling.

Purchasing tickets to my Events is generated through an external website Humantix.

Risks

Any sexual and well-being work can be emotionally triggering. It is important to have a network to support you or if you have any adverse reactions post treatment to contact me or to seek medical advice. I highly recommend you consult with you General practioner or medical specialist prior to working with me.

The use of sexual pleasure toys are designed to enhance and improve sexual pleasure, however, there are always risk involved with toys during sex. It is your responsibility to use pleasure toys as they are intended to be used to reduce risk of injury or other negative outcomes. I highly recommend that you consult with your doctor prior to using my products. Products include but are not limited to; Glass toys, Butt Plugs, sex blankets, intimacy oil and intimacy rub.

The use of my products, including internally is under your own discretion. Dr Jessica Wade will not take any responsibility or liabilities for any accidents, injuries or medical bills that may occur from use or misuse.

If any concerns arise, I strongly recommend you seek advise from your regular general practioner, specialist and/or mental health care team.  It is important to get clearance from your doctor before making major changes to your lifestyle.

My services and products are primarily intended to benefit women, especially women who are ready to work on empowering and improving their sexual health and well-being.

I work with women from a variety of cultural-social backgrounds however you may not be a good fit for working with me if you have unrealistic expectations of sexual health, sexual safety and sexual well-being. You may not be a good fit if you base your sexual health and well-being on the physical body alone. You may not be a good fit to work with me if you are looking to use, misuse or seek sexual gratification through my services.

There is no service I provide that involves the selling of sex or sexual acts. By working with me you agree to a strict professional therapeutic relationship there is no touch or sexual acts performed during any of my services.

Limitation of Liability

If there is a problem with any product, eg minor damage, damage in transit please contact me either through website messages or email drjess@embodiedsexualtherapy.com and we can come to an agreement which includes but is not limited to, replacement, refund.  I will not replace products for change of mind. I do not accept products for return due to sexual health hygienic risks.  

I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to: - replacing the goods or providing the services again; or - if I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

If you feel that there is any problem with your purchase, please let me know within 7 days. I am always keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.

I do not make any guarantees or warranties about the accuracy of any material displayed on this website, with the exception of any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. I am human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let me know.

While I make all reasonable efforts to ensure that this website and my services/products meet with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any loss or damage arising out of or related to my website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim.

You take full responsibility for your implementation of any suggestions that I may make while providing my services. You understand that my advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always consult your own values and vision, do your own research, and check with appropriately qualified professionals before making major decisions or making significant changes. You agree to indemnify me against all consequences arising directly or indirectly from your choices.

You expressly agree that if this limitation of liability is unenforceable for any reason, my total cumulative liability for all causes of action of any kind shall not exceed the amount that you have paid to me for my products/services.

Payment Terms

All payments are made through this website are processed using Stripe and PayPal.

I do not have access to your account details. Any financial information you enter is stored under Stripe's security policy: https://stripe.com/docs/security/stripe or through PayPal.

Delivery and Shipping

I provide face to face appointment at In Health Clinic, Habitat Precinct, Byron Bay and via Zoom. If you do not show for appointment you are expected to pay full appointment fee. If cancel within 24hrs you are expected to pay 50% of fee and if you cancel over 24hours you are not expected to pay fees for intended appointment.

Shipping costs for products are calculator based on Australian post fees. This will be totalled in your purchase. I will post registered mail unless request for express post is made at time of purchase. At this stage I am only shipping to Australia. Please refer Australian Post for their delayed, lost, damaged item compensation policy.

Appointment Policies

If you are unable to attend an appointment, please let me know as soon as possible.  I understand unforeseen circumstances happen, however, in order to keep my business operational I ask for over 24hour notice for cancellation of appointment.  If you are a ‘no show’ you will be charge the full appointment fee, if cancel within 24hours of appointment you will be charged 50% of appointment fee. If over 24 hour notice given for appointment cancellation there will be no fee.  This is subject to my discretion in particular circumstances and events, eg in events outside of your control.  

Refund Policy

There are strictly no refund for change of mind about your purchase. However, I will happily meet with you to discuss your concerns and attempt to negotiate a win/win solution.

If you purchase a product that is discontinued or no longer in stock, I am happy to provide a refund or give you credit to purchase another item of equal value.

If you require a replacement product, I may request a photo for evidence of claim, eg, damaged product.  Replacement product will be sent free of charge however you may be subject to shipping fees. 

Respectful Communication

I reserve the right to delete any comments on my website or social media accounts which is rude, offensive or which I deem to be unacceptable. Keep it polite and play nicely, please.

Dispute Resolution & Jurisdiction

If you have any concerns, issues or complaint arising out of your use of this website, my products or services, or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Please email me at drjess@embodiedsexualtherapy.com.au and expect a response within 2 business days.

If the dispute cannot be resolved by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 100kms of each other. The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of New South Wales or similar neutral authority. We agree to share all the costs of mediation equally between us. We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

If a dispute arises, we all agree that we will not engage in any public discussion about the issues, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonably be expected to unreasonably interfere with any other person’s business or personal interests.

This agreement is subject to the governing law of New South Wales. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.
